Merit Systems Protection Board (MSPB)

The Merit Systems Protection Board (MSPB) was created to protect federal employees from being improperly demoted (including a step or grade change), suspended, reprimanded, or terminated. Yet the rules governing these actions are complex and can be interpreted in different ways in light of an employee’s circumstances. When bringing your case before the board, you will want a veteran lawyer on your team to protect your rights.

The lawyers  at the Federal Employee Law and Litigation Center  are well versed in federal employment law. With our significant experience both representing employees before the MSPB and handling appeals from either the Office of Personnel Management (OPM) or the Office of Special Counsel (OSC), we will seek to obtain the very best possible outcome in your MSPB hearing.

We can support you throughout the entire process by:

  • Filing your initial complaint to the MSPB
  • Reaching an ultimate determination at the MSPB
  • Appealing unfavorable decisions — all the way to the United States Supreme Court if necessary
  • Managing alternate dispute resolution procedures such as mediation or arbitration

Often, our knowledge of federal employment law and MSPB rules and procedure can enable us to achieve a positive result in the administrative hearing or alternative dispute resolution procedure. In addition, we have extensive experience in appealing federal employment law cases in the federal court appeals process as well. If it is needed to achieve justice, we will take your case as far as possible.

If we reach a positive result in your case, you may be reimbursed for your attorney fees, back pay, reinstatement, and medical or other costs your agency would normally have covered.
